Can participants bring any civil action against a fiduciary?

ERISA provides a broad range of possible civil enforcement opportunities. Plan participants or beneficiaries may bring an action to recover benefits due, to enforce rights, or to clarify rights to future benefits under the terms of the plan. Participants, beneficiaries, or fiduciaries may also sue to enjoin any act or practice which violates Title I or the terms of the plan, or to redress such violations or enforce any provision of Title I or the terms of a plan. The Secretary of Labor may seek similar relief for statutory violations involving the reporting, disclosure, or fiduciary responsibility parts of ERISA and, at the request of the Secretary of the Treasury or of participants, beneficiaries or fiduciaries, for violations of the participation, funding or vesting provisions of ERISA. Participants, beneficiaries, fiduciaries, or the Secretary of Labor may also bring an action seeking relief for a breach of fiduciary duty.
