What an employee pension benefit plan is under ERISA

What is an "employee pension benefit plan" under ERISA?

Under ERISA, an "employee pension benefit plan" or "pension plan" is a plan, fund, or program that provides retirement income to employees or results in a deferral of income until the termination of employment or beyond. Thus, profit-sharing or stock bonus plans are generally considered pension plans. Bonuses do not constitute employee plans unless they are systematically deferred until termination of employment or beyond so as to provide for retirement.
